Disclaimer & Competition Terms – Predatortour (NL/EU)

  • This disclaimer and competition terms apply to all events, competitions, the Predatortour website, and the Predatortour Web App (collectively: the “Platform”).
  • By participating in any Predatortour event or competition, or by using the Platform, you agree to these terms.

1. Participation and Eligibility

  • Participation in Predatortour competitions is at your own risk. Participants must comply with all applicable local, national, and European laws and regulations, including fishing, safety, and environmental laws.
  • Predatortour reserves the right to refuse or revoke participation at its discretion, including in cases of suspected fraud, misconduct, or rule violations.
  • Participants must be at least 18 years old, unless participation by minors is explicitly permitted and written consent from a parent or legal guardian has been provided.
  • Participants are solely responsible for obtaining and maintaining all licenses, permits, and authorizations required for fishing and boating in the jurisdictions where they participate.
  • Participants must comply with all applicable fisheries regulations, environmental regulations, navigation rules, protected species requirements, catch restrictions, and closed seasons.
  • Where participants compete in teams, each team member is jointly and severally responsible for compliance with these Terms and the Competition Rules.
  • Participants declare that they are physically and mentally fit to participate in the competition and acknowledge that participation involves inherent physical risks.
  • Predatortour reserves the right to refuse entry, deny participation, or remove any participant or team at any time if participation may pose a safety risk, operational risk, or reputational risk to the event or its stakeholders.

2. Nature of the Competition

  • Predatortour competitions are skill-based events. No element of chance is intended to determine the outcome.
  • Participants are responsible for ensuring that participation is lawful in their country of residence.
  • Participants are solely responsible for verifying whether participation is permitted under the laws of their jurisdiction.
  • Predatortour reserves the right to amend, clarify, or interpret competition rules at any time, including during an ongoing competition, where necessary to ensure fairness, safety, or the integrity of the event.

3. Liability

  • To the maximum extent permitted under applicable law, Predatortour shall not be liable for any direct or indirect damage, including but not limited to:
  • personal injury
  • material damage
  • financial loss
  • loss, theft or damage of equipment;
  • consequential, incidental or indirect damages;
  • arising out of or in connection with participation in events, use of the Platform, or inability to use the Platform.
  • Nothing in this clause excludes or limits liability in cases of intent or gross negligence, or where liability cannot be excluded under EU or Dutch law.
  • Participants acknowledge that outdoor activities and fishing involve inherent risks.
  • Predatortour assumes no responsibility for the seaworthiness, condition, maintenance, operation or legal compliance of boats used by participants.

4. Safety and Responsibility

  • Participants are fully responsible for: their own safety, equipment and compliance with safety regulations.
  • Predatortour is not responsible for accidents, injuries, or damages occurring during the event unless caused by intent or gross negligence.
  • Participants using boats do so entirely at their own risk.
  • Participants are solely responsible for determining whether weather, water, traffic or navigation conditions are safe.
  • Predatortour may suspend, postpone or terminate an event for safety reasons without liability.
  • Boat owners and operators remain solely responsible for the safe operation, maintenance, insurance, and legal compliance of their vessels.

5. Code of conduct

  • Participants must behave in a respectful, sportsmanlike, and environmentally responsible manner at all times. Any form of cheating, harassment, unsafe behavior, or conduct that may damage the reputation or integrity of the event may result in disqualification.

6. Environmental responsibility / fish welfare

  • Participants must handle fish, wildlife, and the environment with care and in accordance with applicable environmental, conservation, and animal welfare laws and standards. Any deliberate harm to fish or violation of environmental regulations may result in immediate disqualification.

7. Insurance

  • Participants are solely responsible for maintaining adequate personal, medical, travel, liability, and boat insurance coverage where applicable.
  • Predatortour does not provide insurance coverage for participants unless expressly stated otherwise.

8. Prizes and Sponsors

  • Prizes are provided by third-party sponsors unless explicitly stated otherwise.
  • Sponsors are solely responsible for compliance with any warranty, consumer protection or product safety obligations relating to sponsored prizes.
  • Predatortour acts solely as organizer and intermediary.
  • Predatortour is not responsible for the delivery, quality, or availability of prizes.
  • Participants must claim prizes directly with the sponsor unless stated otherwise.
  • Any disputes regarding prizes must be resolved with the sponsor.
  • Prizes:
  • must be claimed within one (1) year after the competition
  • are non-transferable unless agreed otherwise
  • do not include travel or additional costs unless explicitly stated
  • Predatortour cannot be held liable if sponsors withdraw or fail to provide prizes.
  • This clause does not affect mandatory consumer rights under applicable law.
  • Predatortour is not the supplier, seller, organizer or provider of sponsor-provided prizes and accepts no liability for the availability, quality, performance or fulfillment of such prizes.

9. Entry Fees, Registration and Refund Policy

  • All entry fees are strictly non-refundable and non-transferable, except where required by mandatory applicable law.
  • This includes, but is not limited to, cases of voluntary withdrawal, personal circumstances, illness, injury, travel disruptions, inability to attend, or any other change in participant availability.
  • Failure to attend or participate in a competition does not entitle the participant to any refund or credit.
  • In the event that Predatortour cancels an event, refunds or alternative arrangements may be offered at Predatortour’s sole discretion, subject to applicable law.

10. Taxes and Financial Obligations

  • Participants are solely responsible for declaring and paying any applicable taxes on prizes in accordance with the laws of their country of residence.

11. Media and Content Use

  • By participating, you grant Predatortour a non-exclusive, worldwide, royalty-free license to use photos, videos, and other content created during the event for promotional purposes, unless you explicitly object in writing.
  • Participants acknowledge that photographs and (live) video recordings may be made during the event and may be used by Predatortour for promotional, editorial and commercial purposes in accordance with applicable privacy laws.
  • This license includes the right to reproduce, publish, edit, distribute and display such content.
  • This includes use by third-party media partners, sponsors, and affiliated event partners for promotional, editorial, and commercial purposes.

12. Platform Use and Availability

  • Predatortour does not guarantee uninterrupted or error-free operation of the Platform.
  • Predatortour reserves the right to modify, suspend, or terminate the Platform or competitions at any time.
  • Predatortour does not guarantee that the Platform is free from viruses, malware or other harmful components.
  • Predatortour is not liable for any errors, delays, or data loss in scoring systems or competition results, including those caused by technical failures, connectivity issues, or user input errors.

13. External Links

  • The Platform may contain links to third-party websites. Predatortour is not responsible for their content or practices.

14. Intellectual Property

  • All intellectual property rights related to the Platform and event materials remain with Predatortour or its licensors.
  • Competition formats, scoring systems, logos, trademarks, branding elements, and event materials constitute protected intellectual property and may not be used without prior written permission.
  • Unauthorized use is prohibited.

15. Indemnification

  • Participants agree to indemnify and hold harmless Predatortour, its employees, partners, and sponsors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees and costs, arising from:
  • violation of these terms.
  • violation of laws or third-party rights.
  • improper or unsafe conduct
  • including reasonable legal fees and costs.

16. Privacy and Data Protection

  • Personal data is processed in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).
  • Participants acknowledge and agree that names, team names, rankings, scores, competition results, photographs, catch data, and related competition information may be publicly displayed on the Platform and through related media channels.
  • Participation is not permitted without a signed registration form confirming acceptance of these Terms and Conditions, the Disclaimer, and the Privacy Policy.

17. Applicable Law and Jurisdiction

  • These terms are governed by Dutch law.
  • Any dispute arising out of or relating to these Terms shall be submitted exclusively to the competent courts of the Netherlands.
  • In the event of any conflict between these Terms and Conditions, the Competition Rules, and any other event documentation, the Competition Rules shall prevail with respect to sporting and scoring matters, while these Terms and Conditions shall prevail for legal, liability, and contractual matters.

18. Force majeure

  • Predatortour shall not be liable for cancellation, postponement, interruption or modification of any event due to circumstances beyond its reasonable control, including but not limited to severe weather, natural disasters, governmental restrictions, technical failures, public health emergencies, war, strikes or force majeure events.

19. Scoring, results and disputes

  • Any protest or dispute regarding scoring, results, or rule interpretation must be submitted within the timeframe specified in the Competition Rules after publication of provisional results. Decisions made by Predatortour are final and binding.
  • All submitted catches, measurements, and supporting evidence are subject to verification by Predatortour. Predatortour reserves the right to reject or invalidate any submission that is unclear, incomplete, inconsistent, or suspected of manipulation or fraud.

20. Final Provisions

  • If any provision of these terms is found invalid, the remaining provisions remain in full force.
  • Predatortour reserves the right to amend these terms at any time.
  • Updated versions shall become effective upon publication on the Platform.
  • Predatortour shall not be liable for cancellation, postponement, interruption or modification of any event due to circumstances beyond its reasonable control, including but not limited to severe weather, natural disasters, governmental restrictions, technical failures, public health emergencies, war, strikes or force majeure events.

22. Order of Precedence

  • In the event of any conflict, inconsistency, or ambiguity between event-related documents, the following order of precedence shall apply:

    1. Competition Rules;
    2. General Terms and Conditions;
    3. Disclaimer & Competition Terms;
    4. Website content, promotional materials, announcements, or other communications.

    The Competition Rules shall prevail with respect to sporting, scoring, competition, and procedural matters. The General Terms and Conditions and Disclaimer & Competition Terms shall prevail with respect to legal, contractual, liability, and administrative matters.
